Examin Website and Service Terms and Conditions

General

The Examin website ("Website") and related services (collectively, the "Service") are operated by Examin Edu Solutions Pvt. Ltd. ("Testbook", "us", or "we"). Access and use of the Service are governed by these Terms and Conditions of Service ("Terms"). By accessing or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms. Examin may amend these Terms and will notify users of changes on the Website for at least 7 days. Changes become effective after this period or upon first access after the changes, whichever comes first. If you do not agree to these Terms, you are not authorized to use the Service.

Description of Website and Service

The Service provides users with online examination preparation tools, including:

• (a) Test Series e-modules,
• (b) printed versions of Test Series e-modules, and
• (c) evaluation services as selected by users.

Examin may modify, suspend, or discontinue any aspect of the Service at any time.

Registration

When registering for the Service, you agree to:

1. Provide accurate and complete information about yourself and/or your organization.
2. Maintain the confidentiality of your password and account information.
3. Update your registration information promptly to keep it current and accurate.
4. Be fully responsible for all activities under your account.
5. Consent to receive communications from us via phone or SMS, even if registered under DND/DNC/NCPR.
6. Provide examination registration details for internal estimation purposes; failure to do so may restrict access to the Service.

Subscriptions

You may purchase a monthly or annual subscription through our website or a third-party platform. Payments may be processed by third parties, and all payments are non-refundable. Subscriptions will auto-renew unless cancelled according to our Terms. Free trials may automatically convert to paid subscriptions unless cancelled in advance.

Your Representations and Warranties

You represent that your use of the Service will comply with these Terms and all applicable laws. You confirm that you own or have rights to any material you submit and grant us the necessary licenses.

Inappropriate Use

You agree not to upload or provide content that is:

1. Libelous, defamatory, abusive, or threatening.
2. Objectionable or restricts others from using the Service.

Indemnification

You agree to indemnify Examin against any losses or claims arising from your use of the Service or any breach of these Terms.

No Representations or Warranties

The Service is provided "as is," without warranties of any kind. Examin does not guarantee service availability or accuracy.

Limitation of Liability

Examin is not liable for indirect or consequential damages related to your use of the Service. Our liability is limited to the amount paid by you for the Service in the 12 months prior to the incident.

Termination

Examin may terminate your access to the Service at any time. You may also terminate your account following our instructions. Certain provisions will survive termination.

Proprietary Rights

All content available through the Service is proprietary to Examin or its licensors. You may not use this content without express permission. Activity Data generated from your use of the Service is owned by Testbook.

Trademarks

"Testbook" and related marks are trademarks of Testbook. Your use of the Service does not grant you rights to use any trademarks.

Privacy

Your use of the Service is also governed by our Privacy Policy, available on our website.

Cancellation Policy

Cancellations are accepted within 24 hours of order placement, except for completed orders or special offers. Contact customer service for issues with received products.

Refund Policy

Refunds are available until a product is dispatched or access details are provided. Requests must include your order number and reasons for the refund.

Copyright Violations

If you believe your copyrighted material is being infringed, you can submit a notice to us following the guidelines provided.

Governing Law

These Terms are governed by the laws of India, and any disputes will be settled in the courts of Mumbai.

Miscellaneous

These Terms constitute the entire agreement between you and Testbook. If any provision is found unenforceable, it will be limited as necessary. A waiver of any provision does not waive future breaches. Examin may assign its rights under these Terms.
